Operating Rules

I. VISITOR'S RESPONSIBILITY

Although we comply with all current applicable regulations, we expect visitors to exercise good judgment and act in a responsible manner to safeguard both their own health and safety and that of those in their charge, especially minors, those who are guarantors and those who must monitor at all times.

In this sense, visitors (i) must READ AND COMPLY with all written regulations, instructions, warnings and recommendations and properly use the leisure facilities, as well as the safety equipment, if any, provided, and (ii) COMPLY AND RESPECT all the instructions and indications provided by our staff.

It is essential that visitors who have people in their charge who, either because they are minors or because they are people with a disability, cannot adequately read or understand the rules, instructions, warnings and/or written recommendations, explain them and remember whenever necessary, without prejudice to the fact that the Selwo Marina staff can provide all the necessary assistance.

Therefore, visitors must act responsibly both for their health and safety, as well as for that of the people in their care and of the other people around them.

Thus, each visitor assumes the commitment to adopt a civic and considerate behavior, both with other visitors and with the staff of Selwo Marina (hereinafter, the "Park"), forcing themselves to respect Selwo Marina and its facilities, the rest of the visitors, employees, as well as the flora and fauna.

Visitors who, in the opinion of the Park staff, fail to comply with the rules and instructions of the staff and/or act irresponsibly and/or disrespectfully towards other visitors and/or the staff, may be expelled from the Park without the right to claim a refund. some. Likewise, the Park reserves the right to bring these attitudes to the attention of the competent authorities.

Please consult the general operating rules of the Park described below, as well as the specific guidelines and rules published at the entrance of each of the leisure facilities, as well as the general operating rules of Selwo Marina described below.

II. CONDITIONS OF USE OF THE FACILITIES

The Park facilities can provide our visitors with wonderful memories and exciting fun! But it can also be an adrenaline-pumping activity that puts your body on edge.

THEREFORE, IT IS VERY IMPORTANT THAT YOU DO NOT PARTICIPATE OR ALLOW A PERSON IN YOUR CHARGE TO PARTICIPATE IN ANY ATTRACTION OR ACTIVITY IF YOU ARE UNDER THE INFLUENCE OF ALCOHOL, OR ANY MEDICATION OR ANY OTHER Narcotic Substance That May Affect Your Health, SENSES, MENTAL ACUITY, REFLEXES AND COORDINATION.

DO NOT PARTICIPATE IN ANY ATTRACTION OR ACTIVITY IF YOU HAVE, HAVE HAD OR THINK YOU HAVE ANY MEDICAL CONDITION, PRE-EXISTING HEALTH PROBLEM OR INJURY, INCLUDING – WITHOUT LIMITATION – HEART, NEUROLOGICAL, MUSCULAR INJURY , BACK, NECK, BONES, JOINTS, TENDONS, LIGAMENTS, BRAIN, EYES, EARS, OR ANY OTHER ILLNESS OR INJURY WHICH MAY BE TRIGGERED OR AGGRAVATED BY THE USE OF THE PARK FACILITIES OR BY PARTICIPATION IN ANY ACTIVITY.

YOU SHOULD ALSO NOT USE - UNLESS OTHERWISE INDICATED - IF YOU ARE (OR SUSPECT YOU MAY BE) PREGNANT; IF YOU HAVE BEEN SURGICALLY INTERVENED IN THE LAST MONTHS OR IF YOU ARE STILL CONVALESCENT OR RECOVERING FROM ANY ILLNESS, ILLNESS, TREATMENT OR MEDICAL PROCEDURE. ONLY YOU CAN DETERMINE THAT YOU ARE PHYSICALLY AND MENTALLY IN ADEQUATE CONDITION TO SAFELY PARTICIPATE IN AN ATTRACTION OR OTHER ACTIVITY.

THE PARK CANNOT GUARANTEE YOUR HEALTH -OR THAT OF THE PERSONS IN YOUR CHARGE-: YOU MUST DETERMINE THAT YOU -OR THE PERSONS IN YOUR CHARGE- ARE IN THE APPROPRIATE CONDITION AND SHAPE TO USE THE PARK FACILITIES, AS WELL AS ANALYZE THAT YOU COMPLY WITH THE LIMITATIONS OF AGE, WEIGHT AND HEIGHT THAT ARE ESTABLISHED IN THE NORMS OF OPERATION.

REMEMBER THAT YOU ASSUME THE RISK OF ANY ACTIVITY YOU CHOOSE TO PARTICIPATE IN. IF YOU HAVE ANY QUESTIONS, OUR STAFF WILL BE HAPPY TO HELP YOU.

III. GENERAL RULES OF OPERATION OF THE PARK

A) Rules and circumstances of access and use1.

  1. The capacity of the park and its different facilities is limited.
  2. No pets, except guide dogs and other accredited assistance dogs, are allowed on the Park grounds.
  3. Access to the Park enclosure with bicycles, skates, scooters and similar items is prohibited.
  4. For security reasons, there are restrictions on access to certain attractions, either for reasons of age, height and/or physical conditions. Find out at the entrance of each attraction about the applicable access restrictions. You can also make your query on the park's website.
  5. Some attractions, shows, restaurants, shops and/or hobbies may remain closed for technical, meteorological or organizational reasons. The Park will try to inform as far in advance as possible through its website, its official profiles on RRSS and at the park's information points.
  6. To temporarily leave the enclosure, it will be mandatory to notify the ACCESS staff before leaving it, since to re-enter you must be duly identified -with the stamp or any other means of identification established by the Park-. Otherwise, you may be denied access to the facilities. Keep in mind that, depending on the type of ticket or Bonoparques you have, you may not be allowed to enter the site again once you have left it. Please review the terms and conditions and consult our ACCESS staff.
  7. All types of sales and the distribution of pamphlets, flyers or products in the Park facilities are prohibited, except those expressly authorized by the Park.
  8. The Park has duly accredited photographers who, if you wish, can take photographs at the entrance or during your visit to the Park.  Apart from these cases, the visitor will be informed in advance if any of the products and/or services contracted additionally involve the taking of photographs and/or videos of the visitor. In any case, the sole purpose of the photographs is to serve as a souvenir for visitors. Photographs not acquired by the visitor will be destroyed at the end of the day, with no possibility of recovery. If the visitor acquires a QR code to download their photograph by digital means, the photographs will be stored for a maximum period of three (3) months for downloading and will subsequently be destroyed, with no possibility of recovery. Under no circumstances will photographs be sold to persons other than or unrelated to those appearing in the photographs.   9. Keep in mind that the Park's objective is for the visitor to enjoy the fullest possible thematic experience, as well as to maintain the facilities in adequate conditions of hygiene and cleanliness, so that the consumption of food and drink is not allowed outside the areas enabled for it. The restaurant terraces scattered around the Park are for the exclusive use of customers who have purchased their food at any of the Park's gastronomy establishments.

B) Safety regulations

  1. The sale and consumption of alcoholic beverages and tobacco is strictly prohibited to those under 18 years of age.
  2. For security reasons, the Park reserves the right for duly authorized personnel to inspect backpacks, handbags, bags or other types of luggage in the cases and within the limits established by law. Access is not allowed with glass containers or cans since they pose a risk to the safety of visitors.
  3. It is essential that visitors to the Park take care and be vigilant with their personal belongings, as the Park cannot be held responsible, for reasons not attributable to the Park, its facilities or its staff, for the loss, theft, robbery or damage that these may suffer during their stay in the Park.
  4. Smoking is prohibited in the queue areas, in the covered areas and, very especially, in the children's area of ​​the Park. In the event that any area is duly designated for smokers, it will be expressly marked. The Park reserves the right to expel from the premises any person who, having been required by Park staff to comply with this rule, continues to fail to comply with it.
  5. The use of remote-controlled aircraft is not allowed in the Park.
  6. The use of selfie sticks in the attractions is prohibited to ensure the safety of visitors. The Park reserves the right to expel from the Park any person who, having been required by the Park staff to comply with this rule, continues to fail to comply with it..

C) Tickets and Bono Parques rules1

  1. The amount of the ticket or, as the case may be, of the Bono Parquess, is only reimbursable in the cases provided for by the applicable regulations.
  2. The entrance to the Park or, as the case may be, the corresponding Park Voucher, must be kept during the entire stay in it, and must be shown to the Park and/or security personnel who require it. The Park reserves the right to expel from the premises any person who, being there, does not have the corresponding entrance ticket or, where appropriate, a valid Park Voucher.
  3. If your ticket includes a free companion, you must access at the same time as the holder and on your first access to the venue.
  4. Certain attractions, services, shows and/or hobbies within the Park grounds are not included in the price of admission. For more information, consult the information point at the entrance of the enclosure or on the Park website.

D) Rules of coexistence

  1. Out of politeness and respect for others, it is not allowed to jump the line or save space for other people in it. Please respect and wait your turn.
  2. So that all our visitors can enjoy the attractions, in all of them at the end of the tour, you must leave the facility following the instructions of the staff, through the route established for this purpose. To use the attraction again, the waiting lines must be respected again.
  3. The visitor must take care of their belongings at all times and it is strongly recommended that they do not leave them unattended. The Park offers visitors a left-luggage service that they can hire upon arrival at the Park. The Park is not responsible, for reasons not attributable to the Park, its facilities or its staff, for the deterioration or loss of the visitor's belongings that have not been deposited in the lockers.
  4. It is forbidden to take photographs and/or videos in the Park in which disrespectful, obscene, illegal, racist, xenophobic behaviour, gestures, clothing, symbols and/or accessories can be seen, or which in any other way harm people's dignity or are inappropriate in a context of family and children's entertainment and/or breach the Park's operating rules. Likewise, the Park reserves the right not to take and/or sell photographs and/or videos in which such conduct could be observed.
  5. The Park does not have a public address system to broadcast personal messages.

E) Breaches

The Park reserves the right of admission and expulsion from its facilities, without the visitors thus inadmissible or expelled having any right to compensation, to people who seriously contravene the regulations listed.

Likewise, and notwithstanding the foregoing, in particular the Park reserves the right of non-admission or expulsion from its facilities to persons who seriously contravene the rules listed below or incur in the following situations:

  1. Serious disturbance of order in the Park or its facilities or the commission of any crime or misdemeanor in them.
  2. Failure to comply with the rules of use and safety of the facilities as well as the instructions given by the lifeguards in this regard.
  3. Improper use of tickets or Bonus Parks (including fraudulent, misleading or bad faith use by the holder and/or the resale or falsification of the same). Only tickets purchased at authorized points of sale will be valid.
  4. Bathing in fountains or water attractions not suitable for this purpose.
  5. Commit acts of vandalism or cause damage to the facilities of the site or to the belongings of its employees.
  6. For behaviors that inconvenience or seriously affect the enjoyment of other visitors.
  7. For leaving unattended minors and people with disabilities in their charge, especially if they incur in the conduct described in the preceding sections.
  8. It will be considered especially serious to leave unattended minors and people with disabilities who do not know how to swim in the bathing attractions.
  9. Consumption, sale or distribution of any type of drug or narcotic substance within the Park premises. The Park will immediately expel any person who fails to comply with this rule and will give the corresponding notice to the authorities.

V. RIGHT OF ADMISSION

Additionally, and in accordance with the Decree 10/2003, of January 28, which approves the General Regulations for the Admission of People in Establishments for Public Shows and Recreational Activities, Selwo Marina has the following specific admission conditions approved by the Benalmádena City Council:

  • This establishment has a maximum capacity of 3,000 people.
  • The minimum age to access this establishment without the company of an adult is 14 years.
  • Selwo Marina reserves the right of admission and expulsion from its facilities to those people who contravene the rules listed below or incur in the following situations:
    • When the capacity is complete.
    •  Of those visitors who, having entered the interior of this facility, do not present their ticket, if required by the park staff.
    • When the person who intends to access the establishment, or is inside it, manifests violent attitudes, especially when they behave aggressively or cause altercations with other people and even with animals or plants.
    • When the person seeking access carries weapons or objects that can be used as such unless, in accordance with the provisions at any time by the specific applicable regulations, they are members of the Security Forces and Bodies or private escorts integrated into private security companies registered for the exercise of said activity and access the establishment in the exercise of their functions.
    • When attendees wear clothing or symbols that incite violence, racism or xenophobia.
    • When the person or persons try to access the facilities closed to the public, and may cause harm to them or to the animals that are in them.
    • When the person who intends to access, or is inside, causes situations of danger or inconvenience to other attendees or does not meet the hygiene conditions. In particular, access, or, where appropriate, permanence in the establishment, will be prevented for those who are consuming drugs, narcotic or psychotropic substances, or show symptoms of having consumed them, and those who show obvious signs or behavior of being intoxicated and/or cause dangerous situations or annoyance to the animals.
    • When the person who intends to access, or is inside, does not respect the safety and hygiene regulations regarding the use of a mask and social distancing included in the park's security protocols.

The following behaviors are not allowed in this establishment:

  • The access of people accompanied by animals is not allowed, with the exception of people accompanied by guide dogs as established by the Law 5/1998, of November 23, relative to the use in Andalusia of guide dogs by people with visual dysfunctions. [Provision repealed by Law 11/2021, of 28 December, which regulates assistance dogs for people with disabilities in Andalusia, allowing access to guide dogs and other accredited assistance dogs].
  • Smoking is not allowed in this establishment except in the areas established for such use: terrace of La Colonial Restaurant.
  • To preserve hygiene, education and respect in the La Colonial restaurant and terrace, the torso must be covered.
  • The use of cameras, video recorders or sound recorders is not allowed in this establishment except in authorized places and never for commercial purposes
